From January 1, 2024, New York Will Enforce New E-cigarette Marketing Rules

Beginning in 2024, New York State will implement similar marketing rules for e-cigarettes and smoke products as other tobacco products.

Manufacturers and distributors will no longer be allowed to place brand names, logos, or other identifying marks on any product other than actual e-cigarettes. They will not be able to offer giveaways related to the purchase of e-cigarettes, and brands will be banned from sponsoring teams and events, such as sporting events and concerts.

Dr. Andrew Hyland, chair of the Health Behaviors Unit at Roswell Park Comprehensive Cancer Center, said this is a welcome step in efforts to reduce e-cigarette use among teens.

"These measures are important," he said. They are a social statement. You don't eradicate tobacco use, vaping, or smoking because you don't have sponsorship, but it's an element. This is a public statement. "

The New York State Association of Convenience Stores expressed support for the new law and others like it, but questioned its impact. President Kent Soprais noted that many of the products that will be marketed, such as flavored e-cigarettes, are already illegal at the state and federal level.

"It may feel good to spend time focusing on marketing strategies and means," he says. But it doesn't really work. To do this, the way to get products out of the hands of teens is to close the stores that sell them. "

Sopres doesn't think the new law will have much of an impact on his members, as he says his store doesn't often carry illegal products that are usually aimed at young people. He noted that the stores that sell these products don't seem to be worried about the law.

"I'm going to ask the sponsors of these bills, the governors and other elected officials to really take a closer look at how to get these products off the streets, and we've had some good conversations with them, and we're optimistic about the upcoming budget year and could see some action," he said. "

The new law would also repeal contractual clauses that suppressed research on the health consequences of e-cigarettes.
