New Virginia Bill Imposes Heavy Fines On Illegal E-cigarettes

A bill on e-cigarette products has been introduced to the Virginia House of Representatives. The two new bills require a $1,000 fine for each product not authorized by the FDA for sale in the United States. The attorney general will draw up a list of legal e-cigarette products with reference to Alabama and Louisiana, and products not on the list will be banned from sale in Virginia.

The new bill also provides that any retailer or wholesaler selling or distributing any liquid nicotine or nicotine vaping product in the state must be subject to scheduled or unscheduled compliance inspections by the Office of the Attorney General for law enforcement purposes.

For e-cigarette manufacturers, they must demonstrate in documents submitted to the Attorney General that their product is covered by an FDA marketing authorization order, either because it was sold in the United States before 2016 or is subject to a premarket tobacco product application before 2020 constraints can be exempted.
